Welcome to XY ConneXion Coaching. These Terms of Use (“Terms”) govern your access to and use of XYConneXionCoaching.com and the training, coaching, educational materials, certification or credentialing opportunities, courses, programs, resources, and related services offered through the website (collectively, the “Services”). By accessing or using the website, creating an account, purchasing a product or program, enrolling in training, or otherwise using the Services, you agree to these Terms. If you do not agree to these Terms, please do not use the Services.
1. Eligibility
XY ConneXion Coaching is intended for adults age 18 and older.
By creating an account, purchasing a program, enrolling in training, or otherwise using the Services, you represent that you are at least 18 years old and legally capable of entering into these Terms.
2. Educational and Coaching Services
XY ConneXion Coaching provides relationship education, coach training, professional-development resources, proprietary educational materials, and related programs.
Specific programs may have additional eligibility requirements, agreements, licensing provisions, credentialing standards, or terms that participants must accept before receiving access.
3. Coaching and Education Are Not Psychotherapy
Unless a service is expressly identified as a separately established licensed mental-health service, XY ConneXion Coaching programs are provided for coaching, educational, training, or professional-development purposes.
Participation does not by itself establish a psychotherapist-client, psychologist-client, physician-patient, attorney-client, or other licensed professional treatment relationship.
Educational and coaching services are not substitutes for individualized psychotherapy, psychological assessment, medical treatment, legal advice, or other professional services when those services are appropriate.
4. Accounts and Account Security
Where an account is required, you agree to provide accurate and current information and to maintain the confidentiality of your login credentials.
Accounts and access credentials are personal to the authorized user and may not be shared, transferred, sold, or provided to another person without written authorization.
You are responsible for activity conducted through your account.
5. Training, Credentialing and Licensing
Certain XY ConneXion Coaching programs may require participants to enter into a separate training, certification, credentialing, or Licensing Agreement.
Where a separate agreement applies, participants must comply with its requirements in addition to these Terms. Completion of training does not guarantee employment, independent-contractor opportunities, referrals, income, professional licensure, certification by an outside organization, or any particular business outcome. Any designation or credential issued by XY ConneXion Coaching is subject to the requirements, limitations, renewal provisions, and standards established for that designation.
6. Right to Refuse, Suspend or Terminate Service
To protect participants, intellectual property, and the integrity of XY ConneXion Coaching programs, we may reasonably deny, suspend, restrict, or terminate access to an account, program, credential, or proprietary materials when:
a participant refuses to execute a required agreement;
a participant materially breaches these Terms or an applicable Licensing or Credentialing Agreement;
proprietary materials are copied, distributed, shared, or used without authorization;
content or conduct associated with the participant is fraudulent, unlawful, abusive, harmful, or materially inconsistent with applicable program standards;
account or platform security is threatened;
continued access creates a material risk to XY ConneXion Coaching, another participant, a client, service provider, or another person; or
another substantial violation of applicable program requirements occurs.
Where appropriate and legally permissible, XY ConneXion Coaching may take reasonable steps to investigate suspected violations and protect its legal rights.
7. Fees and Payment
Prices and payment terms for programs, courses, training, licensing, credentialing, or other paid Services will be disclosed at or before purchase.
Payments may be processed through third-party payment providers. Those providers may independently process payment and transaction information according to their terms and privacy practices.
Users are responsible for charges they authorize.
8. Refund Policy
Because many XY ConneXion Coaching products contain proprietary digital content, training materials, assessments, intellectual property, or information that becomes accessible upon activation, certain purchases may be non-refundable after access has been provided.
Any applicable refund or cancellation terms should be disclosed at or before purchase.
Unless otherwise stated for a particular Service or required by applicable law, activated digital products, downloaded materials, completed assessments, and accessed proprietary course or training materials are non-refundable.
Nothing in this provision limits any refund or cancellation right that cannot lawfully be waived.
9. Intellectual Property
All proprietary XY ConneXion Coaching materials—including training programs, assessments, methodologies, protocols, manuals, videos, written materials, graphics, trademarks, scoring systems, educational content, and related intellectual property—are owned by or licensed to XY ConneXion Coaching and are protected by applicable intellectual-property laws. Purchasing or receiving access to a Service does not transfer ownership of that intellectual property. Unless expressly authorized in writing, users may not:
reproduce or distribute proprietary materials;
share account access;
publish training materials online;
sell or sublicense materials;
remove copyright or trademark notices;
create unauthorized derivative training programs;
systematically extract proprietary content; or
use proprietary materials outside the scope of an applicable license.
10. Professional Responsibility of Coaches and Trainees
Coaches, trainees, licensees, and credentialed participants remain responsible for practicing within the scope of their education, training, professional qualifications, licenses, applicable laws, and ethical responsibilities.
An XY ConneXion Coaching credential does not expand a person’s legal scope of practice or authorize activities requiring a governmental or professional license the individual does not possess.
11. No Guarantee of Outcomes
XY ConneXion Coaching does not guarantee any particular relationship, professional, employment, financial, coaching, business, or client outcome resulting from participation in its Services.
Results depend upon numerous factors outside our control.
12. Acceptable Use
Users may not use the website or Services to engage in unlawful activity, fraud, harassment, unauthorized distribution of proprietary materials, infringement of intellectual-property rights, unauthorized access, interference with website security, or other misuse.
13. Third-Party Services and Links
The website may rely upon or contain links to third-party providers and websites.
Third parties operate according to their own terms and privacy practices. XY ConneXion Coaching is not responsible for the independent practices or content of unaffiliated third parties.
14. Disclaimer of Warranties
To the fullest extent permitted by applicable law, Services are provided on an “as available” basis.
XY ConneXion Coaching does not warrant uninterrupted or error-free operation or guarantee particular outcomes from participation. Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.
15. Limitation of Liability
To the fullest extent permitted by applicable law, XY ConneXion Coaching and its owners, affiliates, officers, employees, contractors, instructors, and service providers will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of or reliance upon the Services.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
16. Changes to These Terms
We may update these Terms periodically as our Services, business practices, or legal requirements change.
The current version will display its “Last Updated” date. Additional notice will be provided where required by applicable law.
17. Governing Law
These Terms are governed by applicable federal law and the laws of the State of California, except where applicable law requires otherwise.
